Terms of Service
Last updated: October 23, 2026 · Version 2026-10-23.1
1. Acceptance of These Terms
These Terms of Service (the 'Terms') are a binding agreement between you and Apes Labs, Inc., a Delaware company ('apes', 'we', 'us' or 'our'), and govern your access to and use of the apes mobile application, the apes.app and app.apes.app websites, our application programming interfaces, and any related software, content and services we provide (together, the 'Service').
By tapping 'Agree and continue' or the equivalent acceptance control, you agree to these Terms. The Privacy Policy explains our handling of personal information; acknowledging it is not consent to every use of data. Separate permission is requested where required, including before an optional photo upload is sent for AI safety review. If you do not agree to the Terms, do not activate or continue the affected Service.
PLEASE READ THESE TERMS CAREFULLY. They explain your self-custody wallet (Section 8), the possibility of total loss when trading digital assets, our regulatory status (Section 11), limits on warranties and liability, and the dispute-resolution provisions in Section 20. SECTION 20 INCLUDES BINDING INDIVIDUAL ARBITRATION, A CLASS ACTION WAIVER AND A 30-DAY OPT-OUT. Nothing in these Terms excludes rights or responsibilities that applicable law does not allow a contract to exclude.
Where we require it, you must re-accept these Terms in the app when they change. The version and effective date of the Terms you accepted are recorded to your account.
2. Eligibility, Restricted Persons and Sanctions
You may use the Service only if you meet all of the following conditions, and by using the Service you represent and warrant that you do:
- You are at least 18 years of age (or the age of majority where you live, if higher) and have the legal capacity to enter into a binding contract.
- Your access and proposed activity must be lawful in your location and must satisfy the geographic and other eligibility restrictions applied to the relevant feature. You must not access a prohibited feature from a jurisdiction where applicable sanctions, licensing or other law prohibits it ('Restricted Jurisdictions'). Availability in an app store, or successful provider onboarding, is not confirmation that every feature is available or lawful for you.
- Neither you nor any person or entity that owns or controls you, nor anyone acting on your behalf, is listed on, or owned or controlled by a person listed on, any sanctions or restricted-party list maintained by the United States (including the Specially Designated Nationals and Blocked Persons List of the U.S. Treasury Department's Office of Foreign Assets Control), the United Nations, the European Union, the United Kingdom, or any other applicable authority (any such person, a 'Restricted Person').
- You are not using the Service on behalf of a Restricted Person or a person located in a Restricted Jurisdiction, and you will not use a virtual private network, proxy, or any other technique to disguise your location or circumvent geographic restrictions.
- You have not previously been suspended or removed from the Service, and you are not prohibited by any applicable law, regulation, court order or contract from using the Service or transacting in digital assets.
- If you use the Service on behalf of a company or other legal entity, you have authority to bind that entity to these Terms, and 'you' includes that entity.
- You are financially and technically sophisticated enough to understand the risks of trading digital assets on public blockchains, including the specific risks described in Section 13, and you are able to bear the total loss of everything you trade.
- Eligibility restrictions can change. We may restrict particular features, assets, networks or locations where required by law or reasonably necessary to address risk. We will provide notice where practicable and legally permitted. Describing a feature in these Terms does not make a disabled or unavailable feature available.
3. The Service and Its Technical Roles
Apes combines profiles, messages, channels and market information with embedded wallets and tools for requesting digital-asset transactions. You choose and confirm each transaction yourself. Depending on the route, our software obtains quotes, builds or validates transaction instructions, checks fees and authorization, may sponsor network costs, and submits signed transactions to a provider or public network. Settlement depends on the relevant networks, contracts and providers.
Embedded-wallet infrastructure is provided by Privy. Wallet authentication, signing, recovery and key export depend on the wallet method and permissions you configure. Each transaction from your wallet requires your approval; our operational fee payer or gas sponsor may also sign its own part of a transaction. Section 8 explains your wallet and keys. We do not ask you to send your private key or recovery phrase to support. Review and secure the recovery methods available for your wallet before putting assets at risk.
An Apes portfolio display is a record or estimate of linked wallets and transactions, not a bank deposit balance maintained by Apes. Funding may pass through a provider-controlled address, contract or payment process before reaching your destination wallet. The role of each provider and the status of a transfer matter; a pending provider transfer is not necessarily money available to spend in your wallet.
These Terms describe product functions and do not remove any responsibility imposed by law. Availability of the app in an app store, or of a feature through a provider, does not mean that every feature is available or lawful in every location; see Section 11.
We cannot guarantee execution, uninterrupted access, any price, protection against every exploit or MEV strategy, or recovery of assets. Confirmed blockchain transactions generally cannot be recalled through Apes. Suspending an Apes account restricts access to our interface and can affect authentication and recovery workflows; it does not erase blockchain assets. Independent wallet access requires that you retain a working recovery or export method.
Network and provider availability is shown for the specific feature. Supported configurations include Solana, Ethereum, Base, BNB Chain, Monad and Robinhood Chain, but configuration alone does not mean every route or live feature is enabled. Features can be restricted by location, provider approval, maintenance, security checks and account status. Test-network assets and sample figures have no spendable live value.
4. Your Account, Sign-In and Security
Sign-in methods offered by the Service can include email confirmation codes, Google and Apple through Privy. Protect your email or identity-provider account, device, device lock, active sessions and wallet recovery methods. An attacker who obtains account or wallet access may be able to authorize transactions. Connecting an X profile is a separate social identity feature; an X logo or verification status is not Apes identity, age, investment or safety verification.
Provide accurate information, keep it current, do not share account credentials, and promptly contact contact@apes.app if you suspect compromise. You are responsible for actions you authorize and for taking reasonable security precautions. Responsibility for unauthorized activity is subject to the facts and applicable law; this paragraph does not waive mandatory consumer rights or excuse our own legal obligations.
You may create only one account per person. You may not create an account for anyone other than yourself, use another person's account, or use automated means to create accounts. We may require additional information or verification at any time in order to maintain your access, including where required by law or by a third-party provider.
Personal and channel usernames share an availability pool. An authorized change releases the old username for reuse; the new holder does not inherit the previous person's account, content, authority or relationships. Only the channel owner may claim or change its username or appoint channel roles. We may reclaim a username for impersonation, infringement, abuse or other justified operational or legal reasons. Do not sell accounts or impersonate someone using a recycled name.
Lost sign-in or recovery access can lead to loss of wallet access and assets. Recovery depends on your configured method and the provider's capabilities; support cannot promise to restore a wallet or reverse a transfer. Never send support a password, confirmation code, private key or recovery phrase.
5. Wallets, Deposits and Withdrawals
Check whether the address displayed is your wallet address or an address assigned by a funding or bridge provider. Follow the exact asset, network and any reference instructions for that flow. A provider may route or convert funds before delivery. Unsupported assets, incorrect addresses or the wrong network can leave funds unavailable or unrecoverable. Do not assume that addresses for different flows or assets are interchangeable.
Blockchain transactions require network fees, and some networks also require account rent or similar amounts. Where sponsorship is enabled, Apes or a provider may pay an operational network cost and recover an amount identified in the transaction disclosure. Sponsorship is subject to route support and limits; it is not a promise of free or unlimited gas.
Only an actually confirmed delivery is available for the relevant balance. Pending, delayed or parked funding can require provider recovery or refund steps, and costs may already have been incurred. An estimated arrival time is not a guarantee. Check transaction history and status before retrying a transfer; a pending transfer can still complete.
A crypto withdrawal sends assets to the address and network you specify using your wallet authorization. Review the destination, asset, amount and any network cost before authorizing it. Interface checks may delay or prevent a transaction for account security, legal restrictions, insufficient balance or an unsupported route. A review screen or transaction reference is not confirmation that the destination has received funds.
Key export is available in the app and requires the authentication and recovery protections of the wallet provider (see Section 8). Exporting or copying a key makes its security your responsibility and can allow anyone holding it to move assets. Preserve a secure, tested recovery method before deleting your account; do not assume later provider access will always remain available.
6. Trading Through Third-Party Protocols
When you initiate a swap, the Service obtains a quote and builds an unsigned transaction using one or more independent third-party routing, liquidity and bridging providers — currently including Jupiter (Solana aggregation), 0x (EVM aggregation), Relay (cross-chain routing and bridging), pump.fun bonding-curve programs, and decentralized exchanges and automated market makers on the supported networks — and then presents it to you to confirm and sign. Signed transactions may be submitted through protected transaction relays (such as Jito on Solana and Flashbots on Ethereum) to reduce front-running. Upon your signature the transaction is broadcast to the relevant blockchain. The providers, the smart contracts they interact with, and the blockchains themselves are operated by third parties that we do not control, and your use of them is subject to their own terms and risks.
The enabled trading interface is for spot swaps. Prices, expected output, market capitalization, liquidity, holder counts and profit-and-loss figures are estimates from indexed data and network state, not binding execution promises. A chart, preview or sample does not create an order or establish that a route can execute.
Quotes can expire or change before execution. Your approved slippage and other limits bound what the signed transaction permits; retries must remain within the authority you supplied or require a new authorization. Trades may fail, revert, be delayed or complete after the interface loses connectivity, and network costs may still apply. Cross-chain routes involve multiple steps and may require provider recovery or refunds in a different asset or network, net of costs already incurred. We do not guarantee speed, liquidity, price, execution, refund timing or the absence of MEV. An authorization cannot reliably be recalled once its transaction is in flight.
Market data, prices, charts, token metadata, holder statistics, trending lists and token-safety indicators shown in the Service are obtained from third-party data providers (currently including Codex and, for token-safety flags, RugCheck and GoPlus) and from public blockchain nodes, and may be delayed, incomplete, inaccurate, manipulated at the source, or unavailable. Token names, symbols and images are set by whoever created the token; anyone can create a token, including one that impersonates a real project, person or asset. A 'safety' indicator is not a guarantee of anything. You must do your own research before every trade.
The Service may display or offer 'minimum' trade sizes, presets, one-tap actions and similar conveniences. These are user-interface features only. You are responsible for every transaction you sign, including one initiated by a mistaken tap.
FIAT ONRAMPS AND BRIDGE FUNDING. Where enabled for your account, Unifold may orchestrate a funding flow using providers such as Coinbase or Stripe. This is separate from the provider used to execute a direct token swap. The payment or onramp provider sets its own eligibility, verification, limits, payment terms, fees and delivery or refund conditions. You may need to accept those terms and submit identity or payment information directly to that provider. A provider's pending approval or test flow does not establish live availability. Payment authorization alone is not proof that crypto has reached your wallet. Apes's crypto withdrawal interface does not by itself offer an ACH, bank-account or finance-app withdrawal service.
7. Fees
The current default Platform Fee is 1% of the applicable swap amount. The transaction disclosure identifies the fee, collection asset and any other amounts required for that route before your authorization. Use that disclosure to distinguish the amount spent, fees and estimated amount received. A different published fee policy can apply prospectively as described below; a stale quote or fee mismatch may require a fresh quote and approval.
Other costs can include network fees, account rent, bridge or relay costs, protocol or liquidity-pool fees, and disclosed recovery of sponsored gas. Some costs are reflected in the route's output. Price impact and slippage affect execution and are not the same as the Platform Fee. Third-party payment and onramp charges are governed by that provider's disclosure.
The Platform Fee rate is the same for every token and every route. Apes does not charge a different rate depending on which token you trade or which provider executes your trade.
A failed or reverted transaction can still incur network or provider charges. Fee collection and any recovery depend on the confirmed transaction and provider process; merely broadcasting an attempt does not establish that every displayed fee was collected. Contact support if a charge or status appears wrong. Nothing here excludes a refund, correction or other remedy required by law.
Material fee-policy changes are prospective and must be disclosed before they govern a new authorization. Existing signed transactions are governed by their authorized instructions. We do not treat a revised fee table as permission to exceed a signed transaction's fee limits.
You are responsible for any taxes, duties or governmental charges arising from your use of the Service, and all fees are stated exclusive of such taxes.
8. Your Self-Custody Wallet and Keys
SELF-CUSTODY. The wallets the app creates for you are embedded self-custody wallets provided through Privy. Apes does not hold your private keys, does not take custody of your digital assets and does not pool your assets with anyone else's. Transactions from your wallet require your approval, and support will never ask for your private key or recovery phrase.
EXPORTING YOUR KEYS. You can export the private key of each wallet from the Wallet screen (Export private keys). Export happens through our wallet provider's secure export window, and the key is shown only to you; Apes never receives it. Anyone who obtains an exported key can move everything in that wallet, so store it offline and never share it. Once exported, keeping that key secure is your responsibility.
WITHDRAWING. You can send your assets to an external address from the app at any time the relevant network is operating, subject to network fees, the security and sanctions checks described in these Terms, and your wallet authorization. Withdrawals are not blocked by regional trading restrictions, except in sanctioned jurisdictions or where the law otherwise requires.
SPONSORED NETWORK FEES AND SMART-ACCOUNT UPGRADES. To pay or sponsor network fees on some EVM networks, the app may ask you to authorize a smart-account upgrade of your wallet (an EIP-7702 delegation to the smart-account implementation the app uses). The upgrade does not transfer your keys or assets to Apes, and each transaction still requires your approval. Where Apes pays a network fee for you, the maximum amount we may recover is shown before you confirm, and it is recovered from a later trade.
LOSS OF ACCESS. If you lose access to your sign-in method and have not exported your keys, you may permanently lose access to your wallet. Apes cannot reset a wallet, recover a lost key or reverse a transfer.
BEFORE YOU DELETE YOUR ACCOUNT. Deleting your Apes account removes our and our wallet provider's ability to help you sign in to your embedded wallets. The app therefore asks you to withdraw your assets or export your keys before you request deletion (see Section 21).
NO DEPOSIT INSURANCE. Apes is not a bank and your wallet is not a bank account. Digital assets in your wallet are not insured by the FDIC, SIPC or any similar program.
10. Leaderboards and Public Data
Depending on audience and privacy settings, users can see profiles, linked X profiles, follows, public posts and reactions, channel information, trading and portfolio statistics and rankings. Direct messages and members chats use separate access rules. Public links may direct someone to the app without displaying a private portfolio on the open web. We do not publish email addresses, sign-in credentials or private keys as profile fields.
You can use Hide profile in the privacy settings to restrict other users from opening your Apes profile and portfolio and to remove it from profile discovery and rankings. Hiding a profile does not erase existing messages, public channel content, blockchain transactions, or copies other people already hold. Messaging permissions and blocking are separate controls.
Wallet addresses and every transaction made from them are public on the blockchain by design and may be linked to your apes profile by us or by third parties. Anyone can see the activity of a wallet address, forever, whether or not you use the Service. If you do not want your trading activity to be public, do not use the Service.
Leaderboard positions, statistics and rankings are computed by us using our own methodology from data we index, may exclude some activity, may be delayed or wrong, and may be changed, corrected or removed at any time. They are provided for entertainment and information only and are not a rating, endorsement or recommendation of any user. PAST PERFORMANCE SHOWN IN LEADERBOARDS, PROFILES OR SHARE CARDS IS NOT A RELIABLE INDICATOR OF FUTURE RESULTS.
10A. Spotlight and Boosted Placements
Spotlight is a row of tokens we choose to feature. Some Spotlight placements are paid for by a token's team or community; each paid placement is labeled "Boosted" on its card, and the token's About section says it is a paid placement. A Boosted placement is advertising. It is not a recommendation, endorsement, solicitation or advice to buy, sell or hold that token, and payment does not change the token's price, the Platform Fee you pay, how your trade is routed or how your order is executed.
"Verified by apes" only means that we have checked that a token's contract address matches the one widely recognized for that token. Verification cannot be bought, is not an audit or an endorsement, and says nothing about a token's value, liquidity or risk. A verified or Boosted token can still lose all of its value.
We decide what appears in Spotlight, may remove any placement at any time, and do not knowingly feature tokens we believe are fraudulent. Do your own research before trading.
11. Regulatory Status, Trade Routing and Availability
REGULATORY STATUS. Apes is not registered with the U.S. Securities and Exchange Commission as a broker-dealer, exchange or investment adviser, and is not a bank. Apes does not provide investment advice and does not recommend or solicit any token or transaction. Boosted placements in Spotlight are paid advertising, not a recommendation (Section 10A).
HOW TRADES ARE ROUTED. For each trade, fixed pre-set rules choose the provider from the token's network and which of your own wallet balances covers the trade, with an automatic fallback to another supported provider when the first has no route. The provider (such as Jupiter, 0x, Relay or pump.fun) selects the liquidity venue. The Platform Fee and the estimated amount you receive are shown before you confirm. The Platform Fee is the same on every route and every token; network costs, provider fees and any recovery of network fees Apes paid for you vary and are shown separately.
AVAILABILITY BY LOCATION. Trading and deposits are unavailable in sanctioned jurisdictions, in regions where we have not enabled them, and when we cannot determine your location. Where trading is unavailable you can still browse, use the social features where permitted, and withdraw your assets (except in sanctioned jurisdictions). We may change the regions where features are available as laws and provider approvals change.
NO REWARDS FOR ACTIVITY. The app does not offer rewards, points, tiers, packs or payments in cryptocurrency or anything else for trading, inviting others, posting or other activity.
12. No Financial, Investment, Tax or Legal Advice
NOTHING IN THE SERVICE IS ADVICE. The Service, including all market data, charts, statistics, leaderboards, token lists, 'trending' or 'new' rankings, safety indicators, notifications, presets, and all content posted by us or by other users, is provided for informational and social purposes only. None of it constitutes, and none of it should be relied upon as, investment, financial, trading, tax, legal or other professional advice, or an offer, solicitation or recommendation to buy, sell or hold any token, position or strategy.
We do not know your financial situation, objectives or risk tolerance, and we do not assess whether any trade or token is suitable for you. The order in which tokens or users appear, and whether something is labeled 'trending', 'new', 'graduated', 'most held' or similar, reflects our data and ranking rules, not our opinion of merit, and does not constitute a recommendation or solicitation to purchase, hold or sell — or to refrain from purchasing, holding or selling — any token.
Make informed decisions and seek advice from a qualified professional when needed. The Service does not assess your personal financial circumstances or provide a promise of suitability. A disclaimer does not eliminate any duty or regulatory classification imposed by law on Apes, a provider or a user.
You are responsible for determining and satisfying your tax obligations. Displayed histories and profit figures may not be complete tax records. Apes or a provider may also have reporting, disclosure or withholding duties where required by law; these Terms do not waive those duties.
13. Assumption of Risk and Risk Disclosures
TRADING DIGITAL ASSETS — AND MEMECOINS IN PARTICULAR — IS EXTREMELY RISKY AND SPECULATIVE. YOU CAN LOSE EVERYTHING YOU TRADE, QUICKLY AND PERMANENTLY. You should only use funds you can afford to lose entirely. By using the Service you acknowledge that you understand and voluntarily assume every risk described in this Section, and all other risks of using experimental blockchain software, and that we are not responsible for any loss arising from them.
By using the Service, you acknowledge and accept in particular that:
- VOLATILITY AND TOTAL LOSS. Token prices can rise or fall by large percentages in seconds, can go to zero and stay there, and may never recover. Most memecoins lose most or all of their value. Liquidity can disappear entirely, leaving you unable to sell at any price.
- SCAM TOKENS, RUG PULLS AND FRAUD. Anyone can create a token. Tokens may be created to defraud buyers, may have hidden mint, freeze, tax, blacklist or transfer-restriction functions, may have their liquidity withdrawn by their creators ('rug pulls'), may impersonate real projects, people or assets, or may be promoted by coordinated groups intending to sell to you. We do not review, vet, approve, endorse or verify any token, token creator, project or user, and a token's presence in the Service says nothing about its legitimacy. A badge or label shown on a token describes objective data only and is not an endorsement.
- SMART CONTRACT AND PROTOCOL RISK. Tokens, bonding curves, automated market makers, aggregators, bridges and the blockchains themselves are software that may contain bugs, vulnerabilities or malicious code, may be exploited, upgraded, paused or abandoned, and may behave unexpectedly. A failure in any of them can result in total loss.
- SLIPPAGE, PRICE IMPACT AND MEV. Execution can differ materially from a quote, especially in thin or volatile markets. Bots can trade around pending transactions and worsen execution. Slippage controls and private or protected routing reduce some risks but do not guarantee protection. Review the limits included in your authorization.
- FAILED, DELAYED, PARTIAL AND UNCONFIRMED TRANSACTIONS. Transactions may fail, be dropped by the network, be delayed, be reverted, be partially filled, or remain unconfirmed for extended periods, and network fees may be consumed regardless. A transaction that appears failed or pending may later succeed; a transaction that appears successful may be reorganized out of the chain. Network congestion and outages are outside our control.
- CROSS-CHAIN AND BRIDGE RISK. Cross-chain transactions pass through multiple providers, contracts and networks. They may take much longer than estimated, may fail after the first step has completed, and may be refunded on a different network, in a different asset, or net of fees and gas already spent. Bridges have historically been targets of large exploits.
- STABLECOIN RISK. USDC and other stable assets are issued by third parties, may lose their peg, may be frozen at the issuer or contract level, and are subject to the issuer's terms and to regulatory action.
- NO APES DEPOSIT INSURANCE. A digital-asset balance displayed by Apes is not an insured bank deposit with Apes. Do not assume FDIC, SIPC or similar protection covers a token, wallet, trading loss or provider failure. Any protection asserted by another provider applies only according to its own product and applicable law, not to the whole Apes experience.
- IRREVERSIBILITY AND USER ERROR. Confirmed blockchain transfers generally cannot be reversed through the Service. Wrong addresses, networks, assets or amounts can cause permanent loss. Review every approval carefully.
- KEY, DEVICE AND ACCOUNT COMPROMISE. Loss or compromise of a sign-in method, device, passcode, recovery method or exported key can cause loss of assets. Phishing and social engineering can be convincing. Recovery is provider- and configuration-dependent and cannot be guaranteed.
- THIRD-PARTY DEPENDENCE. The Service depends on Privy, Jupiter, 0x, Relay, Unifold, Codex, RPC node providers, hosting providers, app stores, identity providers and public networks. Any of them may be slow, wrong, unavailable, discontinued, hacked or changed, and we are not responsible for them.
- MARKET DATA RISK. Prices, charts, market capitalization, liquidity, holder counts and profit-and-loss figures may be delayed, incomplete, inaccurate, manipulated at the source or missing, and you should not rely on them as a sole basis for any decision.
- PAST PERFORMANCE. Leaderboards, profit-and-loss figures, win rates and other statistics reflect past activity we have indexed, may be incomplete or wrong, and do not predict future results.
- REGULATORY AND LEGAL RISK. The legal and regulatory treatment of digital assets, tokens, and services like ours is uncertain and changing across jurisdictions. New laws, regulations, enforcement actions, taxes, or determinations that a token is a security or that a feature is regulated could adversely affect the value of tokens, your ability to use the Service, or the Service's ability to operate, including forcing us to restrict or discontinue features or jurisdictions on short notice.
- SOFTWARE RISK. The Service is new software under active development and may contain errors that cause incorrect displays, failed or duplicated actions, or loss. Features may be changed or removed at any time.
- TAX RISK. Each trade may be a taxable event. You are solely responsible for your taxes.
14. Prohibited Uses
You agree that you will not, and will not attempt to or assist anyone else to:
- Use the Service in violation of any applicable law or regulation, including securities, commodities, anti-money-laundering, counter-terrorist-financing, sanctions, export-control, tax, consumer-protection and privacy laws.
- Use the Service to launder money, finance terrorism, evade sanctions, conceal the proceeds of crime, or transact with a Restricted Person or from a Restricted Jurisdiction, or use a VPN or other means to circumvent geographic or eligibility restrictions.
- Engage in market manipulation, including wash trading, pump-and-dump schemes, spoofing, coordinated trading designed to mislead others, trading intended to exploit other users, or manipulating leaderboards or statistics.
- Create or promote tokens intended to defraud others, or use the Service to sell tokens you know to be fraudulent, impersonating or otherwise deceptive.
- Access the Service through automated means (bots, scrapers, crawlers) or through any interface other than those we provide, except as we expressly permit; or interfere with, overload, probe, scan, test the vulnerability of, or circumvent any security, rate-limit, anti-abuse or access control of the Service.
- Reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of the Service, except to the extent applicable law prohibits that restriction.
- Use another user's account, create multiple accounts, impersonate any person or entity, or misrepresent your identity, affiliation or the source of any content.
- Upload malware or harmful code, or use the Service to phish, spam, harass, threaten, defame or harm anyone.
- Infringe the intellectual property, privacy or other rights of anyone, or post content prohibited by Section 9.
- Use the Service to provide advisory, brokerage, custody, money-transmission or similar services to others, or represent that apes endorses you or your activity.
- Use the Service if you are under 18, or allow anyone under 18 to use your account.
15. Intellectual Property and Feedback
The Service — including its software, design, text, graphics, logos, trademarks, data compilations, rankings and all other content we provide, but excluding User Content and third-party content — is owned by apes or its licensors and is protected by copyright, trademark and other laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the app on devices you own or control, and to access the Service, solely for your personal, non-commercial use. All rights not expressly granted are reserved. 'apes', the apes logo and our other marks may not be used without our prior written permission.
Portions of the Service may include open-source software licensed under their own terms, which govern those portions to the extent of any conflict with these Terms.
If you send us ideas, suggestions or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose without compensation or attribution to you.
16. Third-Party Services
The Service uses independent identity, wallet, routing, payment, funding, data, hosting and moderation providers, including Privy, Unifold, enabled Coinbase or Stripe services, Jupiter, 0x, Relay, pump.fun, Pimlico, Codex, RugCheck, GoPlus and AWS. Third-party websites and X profiles may open in an in-app browser after a warning. A link, logo, verified badge or provider integration is not an endorsement or guarantee. Review the destination and do not share wallet secrets or grant an unfamiliar signing request.
Third-party terms and privacy practices can apply to the activity you request from that provider. Their service may be unavailable, changed, restricted or subject to separate verification, fees and refund procedures. This does not remove responsibilities Apes has under applicable law for its own integration or conduct.
We may add, change, suspend, remove or restrict access to any Third-Party Service at any time without notice or liability.
17. Disclaimers of Warranties
THE SERVICE, AND ALL SOFTWARE, DATA, CONTENT AND FEATURES PROVIDED THROUGH IT, ARE PROVIDED 'AS IS' AND 'AS AVAILABLE', WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, APES AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS AND SERVICE PROVIDERS (THE 'APES PARTIES') DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, THE APES PARTIES DO NOT WARRANT THAT: THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE OR FREE OF HARMFUL COMPONENTS; ANY TRANSACTION WILL BE EXECUTED, CONFIRMED, OR EXECUTED AT ANY PARTICULAR PRICE OR TIME; ANY DATA, PRICE, STATISTIC, RANKING OR SAFETY INDICATOR IS ACCURATE, COMPLETE OR CURRENT; ANY TOKEN, PROTOCOL OR USER IS LEGITIMATE, SAFE OR SUITABLE; OR THAT YOUR ASSETS OR KEYS WILL BE SECURE. ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE SERVICE IS AT YOUR OWN RISK.
WE DO NOT WARRANT, ENDORSE, GUARANTEE OR ASSUME RESPONSIBILITY FOR ANY TOKEN, THIRD-PARTY SERVICE, USER CONTENT OR OTHER USER. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM THE APES PARTIES OR THROUGH THE SERVICE, CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case the exclusions apply to the fullest extent permitted by law.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE APES PARTIES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OPPORTUNITY OR ANTICIPATED SAVINGS, OR FOR ANY LOSS OF, OR DIMINUTION IN THE VALUE OF, ANY DIGITAL ASSET, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE APES PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, THE APES PARTIES WILL NOT BE LIABLE FOR ANY LOSS ARISING FROM: TRADING LOSSES OF ANY KIND; THE VALUE, LEGITIMACY OR BEHAVIOR OF ANY TOKEN; ANY FAILED, DELAYED, PARTIAL, REVERTED, REORGANIZED OR MIS-ROUTED TRANSACTION; SLIPPAGE, PRICE IMPACT OR MEV; ANY ACT OR OMISSION OF ANY OTHER USER; ANY INACCURACY IN OR UNAVAILABILITY OF MARKET DATA, STATISTICS OR RANKINGS; ANY THIRD-PARTY SERVICE, SMART CONTRACT, PROTOCOL, BRIDGE OR BLOCKCHAIN; UNAUTHORIZED ACCESS TO OR LOSS OF YOUR ACCOUNT, DEVICE, KEYS OR ASSETS; ASSETS SENT TO A WRONG ADDRESS OR NETWORK; ANY SUSPENSION, LIMITATION OR TERMINATION OF YOUR ACCESS; OR ANY EVENT BEYOND OUR REASONABLE CONTROL.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE APES PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL PLATFORM FEES YOU PAID TO APES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, AND (B) ONE HUNDRED U.S. DOLLARS (US$100).
These limitations apply only to the extent enforceable under applicable law. They do not exclude fraud, willful misconduct, gross negligence or other liability where exclusion is unlawful, or any mandatory consumer, privacy or financial-service remedy. A contractual cap does not establish that a regulated activity is permitted or excuse a statutory obligation. Some limitations may not apply to you.
19. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless the apes Parties from and against any and all claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Service, including any trade or transaction you make; (b) your User Content; (c) your violation of these Terms, any law or regulation, or any right of any third party; (d) any dispute between you and another user; (e) your taxes; or (f) any misrepresentation by you, including regarding your eligibility, location or sanctions status.
We may assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with our defense. You may not settle any such claim without our prior written consent.
19A. Release
The Service connects you to public blockchains, third-party protocols and tokens, and other users. To the fullest extent permitted by applicable law, you release the apes Parties from any and all claims, demands, damages, losses and liabilities of every kind and nature, known and unknown, suspected and unsuspected, arising out of or relating to: (a) any dispute between you and any other user of the Service, including any squad or channel member and any creator or promoter of any token; (b) any token, including its value, behavior, legitimacy, or the acts or omissions of its creators or promoters; (c) any Third-Party Service, protocol, smart contract, bridge or blockchain; and (d) the outcome of any trade you made through the Service.
IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE § 1542, WHICH SAYS: 'A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.' If you reside elsewhere, you waive any comparable statute or doctrine to the extent permitted by law.
This release does not extend to claims that cannot lawfully be released, and nothing in it releases the apes Parties from their own fraud or willful misconduct.
This section does not release liability for our own conduct where release is prohibited, including gross negligence where applicable, and does not waive mandatory consumer, privacy or financial rights.
20. Dispute Resolution: Informal Resolution, Binding Arbitration, Class Action Waiver and 30-Day Opt-Out
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.
INFORMAL RESOLUTION FIRST. Before either you or apes starts an arbitration or lawsuit, the party raising the dispute must send the other a written notice describing the dispute, the facts, and the relief requested (a 'Notice of Dispute'). Notices to us must be sent to contact@apes.app (or by mail to 175 S 3rd St, Suite 200 #1004, Columbus, OH 43215) and must include your name, handle and the email associated with your account, must be personal to you and signed by you personally (a Notice of Dispute submitted on behalf of multiple persons, or generated in substantially identical form for multiple persons, does not satisfy this paragraph as to any of them), and, if you are represented, must include your counsel's name and contact information. We will send notices to the email associated with your account. You and we agree to negotiate in good faith for at least sixty (60) days after the Notice of Dispute is received, and if either party requests a telephone or video conference during that period, you and we (and counsel, if represented) will personally attend one. Completing this process is a condition precedent to starting any arbitration or lawsuit, and compliance with it may be decided by a court, which may enjoin the filing or prosecution of any arbitration or lawsuit that does not comply. Any applicable statute of limitations, and any contractual deadline in these Terms, is tolled from receipt of a compliant Notice of Dispute until the later of the end of the sixty (60) day period and the conclusion of the process.
AGREEMENT TO ARBITRATE. Except for the matters listed under 'Exceptions' below, you and apes agree that any dispute, claim or controversy arising out of or relating to these Terms, the Privacy Policy, any supplemental or feature-specific terms, the Service, or your relationship with apes, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory, and whether arising before or after these Terms took effect (a 'Dispute'), will be resolved exclusively by final and binding arbitration on an individual basis, and not in court. The arbitrator, and not any court, has exclusive authority to resolve any dispute about the interpretation, applicability, enforceability or formation of this arbitration agreement, EXCEPT that a court (or, where applicable, a small-claims court) will decide: (a) any dispute about the enforceability or application of the Class Action Waiver below; (b) any dispute about the enforceability or application of the Mass Arbitration paragraph below; (c) whether a party has complied with the informal resolution process above; and (d) whether a Dispute is eligible for small-claims court. This agreement to arbitrate is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq., and evidences a transaction involving interstate commerce.
ARBITRATION PROCEDURE. The arbitration will be administered by National Arbitration and Mediation (NAM) (the 'Provider') under its rules in effect when the arbitration is filed, including its consumer rules, consumer minimum standards, and its mass-filing or mass-arbitration supplemental rules and fee schedules, all of which are expressly incorporated into this agreement and are available on the Provider's website. The arbitration will be conducted by a single neutral arbitrator. Unless you and we agree otherwise, any in-person hearing will take place in the county where you reside, and any party may elect to appear by video conference. The arbitrator may award the same individual relief that a court could award, including injunctive or declaratory relief, but only in favor of and to the extent necessary to provide relief warranted by the individual claim. The arbitrator's award will be final and binding and may be entered as a judgment in any court of competent jurisdiction. Payment of filing, administration and arbitrator fees will be governed by the Provider's consumer rules and fee schedules; if those rules or applicable law require us to pay a larger share of such fees for a consumer claim, we will. If the arbitrator finds that a claim, or the conduct of any party or counsel, was frivolous or brought for an improper purpose (under standards comparable to Federal Rule of Civil Procedure 11(b)), the arbitrator may reallocate fees and costs as the Provider's rules and applicable law permit.
CLASS ACTION AND JURY TRIAL WAIVER. YOU AND APES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLASS MEMBER OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. YOU AND APES EACH WAIVE ANY RIGHT TO A JURY TRIAL. If a court decides that applicable law precludes enforcement of this Class Action Waiver as to a particular claim or particular request for relief (such as a request for public injunctive relief), then that claim or request for relief (and only that claim or request for relief) must be severed from the arbitration and brought in court under Section 24, and all other claims and requests for relief will be arbitrated; in that event the parties agree that the court proceeding will be stayed pending the outcome of the arbitration. IN NO EVENT WILL ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE CLAIMS BE ARBITRATED.
MASS ARBITRATION. If twenty-five (25) or more Notices of Dispute or demands for arbitration raising similar claims are brought against apes (or against you) by or with the assistance or coordination of the same law firm, group of law firms, or organization, the parties agree that the Provider's mass-filing or mass-arbitration rules will apply, supplemented as follows. The demands will be resolved in batches of up to one hundred (100), with batches proceeding in parallel to the extent the Provider can administer them, and never conditioned on the completion of a prior batch. Before the batches proceed, up to twenty (20) demands will be selected as initial bellwether arbitrations, half selected by the claimants (or their counsel) and half by apes. The results of a bellwether or of any arbitration are binding only on the parties to that arbitration and have no preclusive effect on any other person's claim. Within ninety (90) days after the last bellwether award, the parties will participate in a single global mediation of the remaining demands, with the mediator's fees paid by apes. If a demand remains unresolved after that mediation, either the claimant or apes may elect, by written notice, to have that demand resolved in court under Section 24 instead of arbitration, on an individual basis; absent such an election, the remaining demands proceed in batched arbitration as described above. Provider fees for demands that have not yet been assigned to a proceeding are deferred until their batch proceeds, as the Provider's rules permit. Any statute of limitations, and any contractual deadline in these Terms, is tolled for each claimant from the filing of that claimant's Notice of Dispute until that claimant's demand is finally resolved, withdrawn or settled under this paragraph. This paragraph applies equally to demands brought by apes and to demands brought by users, and is intended to make resolution of similar claims fairer and more efficient for everyone; it does not limit the substantive relief available to any individual claimant.
30-DAY RIGHT TO OPT OUT. You may opt out of this arbitration agreement and the Class Action Waiver by sending an email to contact@apes.app with the subject line 'Arbitration Opt-Out' within thirty (30) days after you first accept these Terms. The email must include your full name, your apes handle, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms, and disputes will then be resolved in court as provided in Section 24. A later re-acceptance of these Terms (for example, after an update) does not restart the opt-out period if you have already opted out and does not undo your opt-out.
EXCEPTIONS. Either party may bring (a) an individual action in small-claims court for a Dispute within that court's jurisdiction, and (b) a lawsuit seeking injunctive or other equitable relief in court to protect its intellectual property rights or to stop unauthorized use or abuse of the Service. This Section does not prevent you from reporting a matter to, or seeking relief from, any government agency.
SEVERABILITY AND SURVIVAL. If any part of this Section other than the Class Action Waiver or the Mass Arbitration paragraph is found unenforceable, the remainder will remain in effect. If a court finds the Class Action Waiver or the Mass Arbitration paragraph unenforceable or inapplicable as to a Dispute or set of Disputes (other than through the limited severance described in the Class Action Waiver paragraph itself), then this agreement to arbitrate is void as to that Dispute or those Disputes, which will proceed in court under Section 24 — individually, to the fullest extent the court's ruling permits — and in no event as a class, collective or representative arbitration. This Section survives termination of these Terms and of your account.
TIME LIMIT ON CLAIMS. To the extent permitted by law, any Dispute must be filed within one (1) year after the events giving rise to it first occurred, or it is permanently barred. This period is tolled as described in the informal resolution and Mass Arbitration paragraphs above, and nothing in this paragraph shortens any period that applicable law does not allow to be shortened.
MANDATORY RIGHTS. No informal process, batch procedure or contractual deadline delays a legally required safety removal, privacy response, regulatory report or remedy that cannot lawfully be delayed. You may contact regulators and exercise non-waivable rights without completing an informal dispute process. Any compulsory delay, waiver, fee allocation or limitation above applies only to the extent permitted by applicable law.
21. Suspension, Termination and Account Deletion
BY YOU. You can request deletion of your account in the app at any time: Profile, then Settings, then Delete account. Before the request is accepted, the app asks you to withdraw your assets or export your wallet keys (Section 8), because deletion removes sign-in access to your embedded wallets. If you signed in with Apple, you confirm with Apple once so we can revoke Apes's access to your Apple ID. Your account is then scheduled for deletion 30 days after the request; until then you can cancel in the same place, and new trades are paused while withdrawals remain available. After the 30 days we delete your account, sign-in identity and personal data, except records we must keep by law as described in the Privacy Policy, and we email you when deletion is complete. See https://apes.app/delete-account or contact support for status. Privacy-rights requests are described separately in the Privacy Policy.
BY US. We may suspend, limit, restrict or terminate your access to all or part of the Service, remove your content, disable features, or reclaim your handle, at any time, with or without notice, if we believe in good faith that you have violated these Terms or applicable law, that your activity creates risk or legal exposure for us or others, that a competent authority has required it, or for any other reason or no reason, including discontinuing the Service. Where practicable and lawful we will tell you why.
EFFECT. Account deletion or suspension can affect sign-in, app records and access through embedded-wallet services. It does not erase public blockchain transactions or itself withdraw or destroy assets. Secure recovery access and address pending financial activity before final account deletion. Required records may be retained with restricted access. Any fee correction, refund, outstanding entitlement or restriction remains subject to applicable law and the relevant transaction, rather than automatic forfeiture merely because an account is closed.
SURVIVAL. Sections that by their nature should survive — including Sections 3, 5 through 8 (as to completed transactions), 9 (as to the content license), 12 through 20 (including the Release in Section 19A), and 23 through 26 — survive any termination.
22. Changes to These Terms
We may revise these Terms prospectively and will publish the version and date in the app and at https://apes.app/terms. The app requires acceptance of the current version before the affected account features continue. Material changes must be disclosed before applying to new authorizations, with additional notice or consent where law requires it. A revised document does not alter an already signed transaction. If you decline, other features stay unavailable until you accept, but you can still withdraw your assets or export your wallet keys from the Wallet screen, request account deletion, and contact support about your legal rights.
Changes to the arbitration agreement in Section 20 will not apply to any Dispute for which you had already given a Notice of Dispute before the change took effect.
23. Apple App Store Terms
If you downloaded the app from the Apple App Store, the following additional terms apply. In the event of a conflict between this Section and the rest of these Terms with respect to the app store version of the app, this Section controls to the extent of the conflict.
ACKNOWLEDGEMENT. These Terms are between you and Apes Labs, Inc., not Apple Inc. Apes is responsible for the app and its content. Applicable app-store usage rules and mandatory terms remain effective; these Terms do not override them or restrict a right those rules require. An applicable custom license must comply with Apple's minimum end-user license requirements.
SCOPE OF LICENSE. Your app license is non-transferable and permits use on Apple-branded products you own or control under the applicable Apple Media Services Usage Rules, including permitted Family Sharing, volume purchasing and Legacy Contact access. This is a license to the app, not permission to share wallet credentials or bypass financial account authorization.
MAINTENANCE AND SUPPORT. apes is solely responsible for providing any maintenance and support services for the app, as specified in these Terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the app. Support is available at contact@apes.app.
WARRANTY. apes is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any) to you; to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be apes's sole responsibility. The app is currently free to download; no in-app purchases are offered.
PRODUCT CLAIMS. apes, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession or use of the app, including: (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar legislation.
INTELLECTUAL PROPERTY CLAIMS. In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, apes, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such claim.
LEGAL COMPLIANCE. You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a 'terrorist supporting' country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
DEVELOPER CONTACT. Direct questions, complaints or claims about the app to Apes Labs, Inc., 175 S 3rd St, Suite 200 #1004, Columbus, OH 43215, United States; contact@apes.app; +1 (330) 304-2009.
THIRD-PARTY TERMS. You must comply with applicable third-party terms of agreement when using the app (for example, your wireless data service agreement and the terms of the identity provider and blockchain services described in Section 16).
THIRD-PARTY BENEFICIARY. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they relate to your license of the iOS app, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
24. Governing Law and Venue
These Terms, and any Dispute, are governed by the laws of the State of Delaware and the federal laws of the United States, without regard to conflict-of-laws principles that would require the application of any other law, except that the arbitration agreement in Section 20 is governed by the Federal Arbitration Act.
Subject to Section 20, and for any Dispute that is not subject to arbitration (including if you have validly opted out), you and apes agree that the state and federal courts located in Delaware will have exclusive jurisdiction, and you consent to personal jurisdiction and venue in those courts and waive any objection based on inconvenient forum. Nothing in this Section deprives you of any mandatory protection of the consumer law of the place where you reside, to the extent that law cannot be varied by contract.
The Service is controlled and operated from the United States. We make no representation that the Service is appropriate or available for use in any particular location. If you access the Service from outside the United States you do so on your own initiative and are responsible for compliance with local law.
To the extent any Dispute proceeds in court rather than in arbitration — including because you validly opted out of arbitration under Section 20 or because a claim was excepted or severed — YOU AND APES EACH WAIVE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY RIGHT TO A TRIAL BY JURY, and agree that any such Dispute will be decided by a judge sitting without a jury. Where applicable law does not permit this waiver, it does not apply.
25. Miscellaneous
ENTIRE AGREEMENT. These Terms, together with the Privacy Policy and any additional terms we present in the app for specific features ('Supplemental Terms'), are the entire agreement between you and apes regarding the Service and supersede all prior agreements and understandings, written or oral, relating to the Service. Supplemental Terms are part of these Terms and are subordinate to them: unless the Supplemental Terms expressly state that a dispute-resolution provision of theirs replaces Section 20, any dispute arising out of or relating to Supplemental Terms is a 'Dispute' governed by Section 20, and in any conflict about which dispute-resolution provision governs, Section 20 controls.
NO RELIANCE. You acknowledge that, in accepting these Terms and in using the Service, you have not relied on any statement, promise, assurance or representation that is not expressly set out in these Terms. Nothing in this paragraph excludes or limits liability for fraud or fraudulent misrepresentation. This does not exclude a remedy for misleading marketing or other conduct where applicable law protects that remedy.
SEVERABILITY. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
NO WAIVER. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. Any waiver must be in writing and signed by us.
ASSIGNMENT. You may not assign or transfer these Terms or any rights under them without our prior written consent, and any attempt to do so is void. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization or sale of assets, and these Terms will bind and benefit our successors and assigns.
FORCE MAJEURE. We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, government action, epidemics, power or internet failures, blockchain network congestion, forks, halts or outages, and failures of third-party providers.
NO THIRD-PARTY BENEFICIARIES. Except as provided in Section 23 and for the apes Parties under Sections 17 through 19, these Terms do not confer any rights on any third party.
EXPORT CONTROLS. You may not use, export, re-export or transfer the app or the Service in violation of U.S. export laws and regulations or any other applicable export or sanctions law.
ELECTRONIC COMMUNICATIONS. We may provide service information electronically through supported in-app, email or notification channels. Where law requires a particular form of notice, consent, delivery or a paper alternative, that requirement controls. General acceptance of these Terms does not replace a separate electronic-record consent required by law.
CALIFORNIA USERS. Under California Civil Code § 1789.3, California users are entitled to the following notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
INTERPRETATION. Section headings are for convenience only. 'Including' means 'including without limitation'. These Terms will not be construed against the drafter.
LANGUAGE. The Terms are drafted in English. Any mandatory local-language, interpretation or consumer-protection requirement remains applicable.

9. Social Features and User Content
The Service supports profiles, posts, channels, optional members chats, direct messages, replies, reactions, callouts and theses ('User Content'). You retain ownership. You grant Apes a non-exclusive, royalty-free license to store, format, transmit and display content as needed to provide the requested features to their intended audience and to perform safety, support and legal functions. Service providers may perform those functions for us. This does not authorize publishing private chats in advertising or using your content for unrelated promotion. Retained copies and deletion limits are described in the Privacy Policy.
You are solely responsible for your User Content and represent that you have all rights necessary to post it and grant the license above, and that it does not violate these Terms or any law or third-party right. Other users' posts, takes, theses and trades are their own opinions and activity. WE DO NOT ENDORSE, VERIFY OR VOUCH FOR ANY USER CONTENT OR ANY USER, and User Content is not advice from us. A statement by another user that a token is good, safe, 'about to pump' or anything else is exactly as reliable as a stranger on the internet.
Do not upload nudity or sexually explicit material, including in profile images or banners. Nonconsensual intimate images, sexually explicit deepfakes, child sexual exploitation, trafficking, threats, hateful harassment, doxxing, fraud, market manipulation, impersonation, intellectual-property infringement, malicious links and spam are prohibited. Do not coordinate pumping or wash trading, falsify performance, conceal paid promotion or disclose another person's private information. These rules apply to public and private spaces, including attachments and profile metadata.
ZERO TOLERANCE. Apes has zero tolerance for objectionable content and abusive users. By using the social features you agree not to post objectionable content or abuse other users. We remove objectionable content and suspend or permanently remove the accounts of users who post it or who abuse others.
We use automated checks and authorized human review to enforce these rules, and may remove or restrict content, suspend participation, or take other proportionate action. Automated checks can miss harmful material or reject permissible material; use support to report a mistake or appeal. We must respond to reports and comply with applicable removal, reporting, preservation and disclosure duties. Moderation does not guarantee that all harmful material will be detected before anyone sees it.
The Service provides tools to report content and users and to block other users. Blocking restricts direct contact and visibility within supported social features; it does not erase messages already received, public blockchain data or copies held by others. Reports are submitted for moderation review, and we review reports within 24 hours. You can also report safety concerns to contact@apes.app. Where a violation is confirmed, moderation actions can include removing content and restricting or suspending the responsible account.
If you believe content on the Service infringes your copyright, send a notice to contact@apes.app that includes: your physical or electronic signature; identification of the copyrighted work; identification of the material claimed to be infringing and information sufficient to locate it; your contact information; a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner. We may terminate the accounts of repeat infringers.
CHANNELS, CHATS AND ATTRIBUTION. Channel owners manage usernames and roles. Authorized channel publishers can post using the channel name and image while internal authorship is retained for permissions and safety. An attached members chat is optional. Membership is required to comment or participate where specified; leaving removes participation access but does not delete prior comments. Authors can delete their own comments and authorized moderators can remove content; replies may remain after the original text disappears. Only the channel owner may send links in the members chat. A role or an anonymous channel byline does not exempt anyone from these rules.
INTIMATE-IMAGE REMOVAL REQUESTS. A depicted person or authorized representative may contact contact@apes.app with the subject 'Intimate image removal'. No Apes account is required. Include a physical or electronic signature, enough information to identify and locate the image, a brief good-faith statement that it was published without consent with supporting facts, and contact information. Do not send the intimate image itself or an identity document by email. Applicable law can require removal within 48 hours of a valid notice and reasonable efforts to identify and remove known identical copies; preservation required by law is handled separately from public availability. See https://apes.app/support#intimate-images.
